8/2: Infopass Appointment @ San Jose -- IO bought the file to the counter and asked for EVL and also a letter from company stating they support my I140.
I work for Top 5 company in Silicon valley. Company attorney got the required documents in 3 days. IO also generated FInger Printing appointment the same day.
8/11: Infopass Appointment @ San Jose -- Submitted the EVL and other documents given by the company. IO made copies of our Finger Printing notice.
8/19: Infopass Appointment @ San Jose -- Officer checked the status of our case and indicated visa number has been assigned. Files are with the same officer.
8/20: Card Production ordered for my wife and myself.
{ 10 yr + 6 Months in this country ( F1 - Masters - H1 - Green Card)
Thanks to VLDRao / Q for starting to predict dates in EB3- Eb2 prediction thread which really gave me hope of getting my green card.

My Attorney mailed 225 Packages via DHL shipped at June 30 12:00 EST on Saturday, I was 5 minutes late so mine went on 4:00 PM FEDEX.

I dont why FEDEX guys are delivering yet they said will eb delivered by 8:00 AM on Monday but their website shows "Estimated delivery Jul 2, 2007 by 10:30 AM" it is 10:30 already and there is no update yet(may be they don't have enough trucks to carry all the application to DOS).

I am July 2nd filer from last year. I did receive a FP notice in Oct 2007 but couldn't go for it. I sent a letter asking for another date but TSC..So go figure!...


Is e-filing costly? - NO
Does paper based filing not trigger FP? - NO
Is it slower? - NO

3. go to the gym. workout. jog. lift weights. play a game.
table tennis really helps.
resolve to be your fittest.
adversity must make us stronger, not weaker.

4. travel internationally
take a trip to some country you've never gone to before.
observe people's olympic struggles.
it's part of the human experience.

5. learn a new skill
something you've always wanted to do but did'nt get around to.
public speaking, dancing, singing...your choice.
take a class at a community college or a university.

6. go to temple or church or mosque.
make a deeper spiritual connection with God.
let him lift some of your burden.
i listened to Hari Om Sharan after many years and experienced a real sense of joy.

7. spend time learning about US government.
get to know more about how government works. why does house vote differently than the senate ?
get to know the 100 senators and 435 house reps. especially how they stand on legal immigration.
our friends on the other side of the fence have done us a favor by organizing this information

8. learn from IV efforts of previous years
many skills were introduced which could have helped us. what can we learn from what failed ?
e.g. comprehensive immigration bill 2006. it passed in the senate but stalled in the house.
Gandhigiri did work this year. it was a major success story we should celebrate and learn from.

9. accept and enjoy the present.
accept the present moment. breathe.
enjoy nature - the sun, the moon, the heavens, fresh air and water. make new associations and friends.
experiencing these gifts of life is enough to keep one happy.

10. write it out.
record the feelings you are going through in writing.
capture the details.
what was your journey, your expectations, your highs and lows ?
you may see your struggles in a different light 10 years from now.

Sad to hear your situation. Greg Siskind has discussed some of the legal options on his blog http://blogs.ilw.com/gregsiskind/

As others have suggested, if possible your spouse should pursue her own path to GC through H1B employer as a realistic option. IV members would help in the job search.

In Fox News this afternoon, the senator has explicitly said that the Chicago lady does not have any "constituional rights" since she is not American citizen. Go figure what they think about us.
The case should not have been accepted if the lady does not have constitutional rights. Lets see if they reject the case on this basis after listening to Tancredo.

I would say that Social Sec Taxes and Medicare are unfair taxes. Some H-1Bs (read people from India and China) are not treated the same way as citizens, Green Card holders, and othe H-1Bs (read from Western Europe). Since they wont give us GC's.., we have to eventually go home. This implies, no Medicare or Social Sec benefits. Going by a conservative estimate.. there are about 500,000 GC applications in the blackhole for an average of 3 yrs. Each pays on an average $4,200 SC and Medicare taxes. So the state owes us $6.3 Billion... We sincerely request that we be treated fairly and our money be given back to us.. OR.. easy for them, give us GC

$ 6.3b !!!!! How and where did one get that figure, I am not sure. But I certainly feel SSN money may be considered to given back to H1's who have stayed here for significant number of Years and acchiveing nothing -- GC.

I feel that is fair request. I hope this becomes a formal request to appropriate Office to consider. What do you guys think on the Forum.

Just because i gave my predictions which were not favorable to the person, Someone gave me a red.:mad: Guys take it sportively, We are just doing a prediction games, If someone predicts dates which is favorable or unfavorable doesn't mean USCIS / State dept will use the same dates, They will use what is on their minds.

By the way the guy gave me comment EB3 india will be June 2002 funny

I applied for the first time in 2001, and then in 2005 (due to relocation) and ended up at the backlog center. Another relocation and now my PD is March 2007, and these recent wannabes want Perm approved in 1 month, I-140 premium processing in few days and then onto I-485 which should be current with no retrogression. Amen !! When do you want the USCIS to bend over for you?

:D ... couldn't stop laughing, the gov't should move the H1B quote to 250K/year and keep the GC to 140K/year, US will then get over a million people in the next 4 years.

forward looking scenario -

If nothing happens in the next 4 years then everyone who's here would still be here talking the same things as right now (with their bewildered hope of getting thru), the difference being all the 2005-2007 would also be old timers then, That would really change their perception.

Hey, this is just an opinion. nothing to debate on .... pure speculation. if you want me to give the full disclosure on forward looking scneario I can get that done but I'll have to rip it off some analysts comments :cool:

This is what I don't understand. Priority dates are set so only applications before that date can be approved. Processing dates are not set in that sense of the term.

All uscis does every month when they publish processing dates is look at the Receipt date of the application still pending at the time and publishes that info. So in that sense, "not moving the processing date" does not make sense. Unless you mean they deliberately reduce the number of hours they work so fewer applications are processed.

USCIS deliberately can do many things and is doing. It can transfer files from one center to ther and inroduce the delay. During July 2007 fiassco, many members of IV experienced that files were flying between nebraska and california centers without apparent reason. If you have followed processing dates in past you would surely have obeserved dates not moving at all for months. Does that mean nobody was working at USCIS at that time? No.. What it means - " We have heavy work load and we want to go in particular direction and so we are delaying" - in terms of USCIS. In our interpretation - USCIS does not work and want us to rot forever.

For variety of reasons, I wish to explore option of consulting instead of permanent corporate job. Can I do consulting in my own name directly or do I need to be associated with some company?
Green card (EB-2, Nov 29,2004 PD) application is in my name. I have filed 485 this July and expecting my EAD any time. I will be invoking AC21 after 6 months.
But need answer to this question
A. Consult on own?
B. Go through a consulting company?

I prefer option A.

I did cate 2 FP and received LUDs on I-765 and I-485 but when I received the EAD card, it said FP is not available. Based on that I assumed the FP was only I-485 related.
